Q1. What is the importance of rights in a democracy?

A1. Rights are necessary for the very sustenance of democracy. They are important in the following ways:

i) Political rights like right to vote allow people to elect their rulers.

ii) Because of rights, people enjoy various freedoms like freedom of speech, expression, belief, faith and worship.

iii) Rights protect minorities from the oppression of the majority. Rights of minorities ensure that the majority cannot do whatever they want.

iv) Some rights ensure that the government does not misuse its powers and attack the freedoms of its own citizens.

Q2. Explain the provisions of right to equality as mentioned in the Indian constitution.

A2. Right to equality (mentioned in Articles 14-18) -

i) Rule of equality (equality before law): It means that no person is above the law. The government shall not deny any person in India equality before the law or equal protection of laws.

ii) There is equality of opportunity in matters of employment or appointment to any position in the government.

iii) Prohibition of discrimination and access to public places and services: The government shall not discriminate against any citizen on basis of religion, race, caste, sex, place of birth. Every citizen shall have access to public services and places like shops, roads, playgrounds etc.

iv) Abolition of untouchability: The constitution mentions untouchability as one extreme form of social discrimination. It clearly directs the government to put an end to it. Practice of untouchability has been forbidden in any form.

Q3. Mention the freedoms listed under Article 19 i.e. right to freedom.

A3. Freedoms listed under Article 19 are - 

i) Freedom of speech and expression.
ii) Freedom of assembly without arms in a peaceful manner.
iii) Freedom to move in any part of the country.
iv) Freedom to reside anywhere.
v) Freedom to carry out any trade/ business/ occupation.
vi) Freedom to form association/ unions.
vii) Right To Information Act (RTI 2005).

Q4. What are the rights of arrested persons?

A4. i) A person who is arrested/ detained in custody will have to be informed of the reason for such arrest/ detention.

ii) A person who is arrested/ detained in custody shall be produced before the nearest magistrate within a period of 24 hours of arrest.

iii) Such a person has the right to consult/ engage a lawyer for his defence.

Q5. Explain the reasonable restrictions mentioned under the right to freedom.

A5. Restrictions on-

1) freedom of speech and expression:

i)  This freedom cannot be used to instigate violence against others.

ii) It cannot be used to incite people to rebel against the government.

iii) It cannot be used to defame other by saying false and mean things that cause to their reputation.

2) freedom of assembly:

i) Assemblies have to be peaceful. They should not lead to public disorder or breach of peace in society.

ii) Participants in any assembly cannot carry weapons with them.
